ATTENDANCE POLICY/TERMINATION POLICY
New Horizons Consumer Learning Center of San Antonio, LLC will follow the guidelines for attendance as set forth in the Texas Administrative Code Title 40 Part 20 Chapter 807 Subchapters 807.171 and 807.173
(a) A school shall terminate the enrollment of a student who accumulates the lesser of the following
amounts of absences:
(1) more than 10 consecutive school days;
(2) more than 20% of the total clock hours in a course of more than 200 clock hours;
(3) more than 25% of the total clock hours, if the course or individual subject is 41 to 200 clock hours in length;
(4) more than 25% of the total clock hours for seminars, individual subjects, or courses of 40
clock hours or less; or
(5) any number of days if the student fails to return as scheduled from an approved leave of
Absence*.
(b) Students whose enrollments are terminated for violation of the attendance policy may not reenroll before the start of the next progress evaluation period. This provision does not circumvent the approved refund policy.
A school shall charge for a full day of absence when the student fails to attend all of the scheduled classes on that day. The school shall charge for a partial day of absence for any period of absence during the day.
Attendance codes are as follows: Present, Absent, Tardy, Enrolled, Dropped, and Withdrew.
CONDUCT POLICY
A student that does not follow the attendance and progress policies can be terminated from school. Other terminations may occur such as a student’s misconduct. If a student becomes unruly due to excessive negative comments, profanity, or comments of a sexual, derogatory manner will be escorted from the class by the instructor. Re-admission will be determined through management and their assigned counselor. Re-admission will be on a case by case basis.
Absences, incomplete classes, student lack of retention of class knowledge will be reported to management and their assigned counselor. The manager, counselor, and the student will meet to address the conduct and will determine how best to get the student back on track. Further unsatisfactory conduct will result in the termination from the class/course.
Students may be dismissed from a course due to misconduct on the premises. This can include, but not be limited to illegal activity, behaving in a threatening manner, or disrupting the class. The student may resume his/her training after consultation if the matter is resolved.
GRADING SYSTEM
The grading system for New Horizons Consumer Learning Center of San Antonio, LLC will vary depending on the type of subject being taken. If an individual is attending an applications subject (ex. Excel, etc.) the grade will consist of either a pass or fail. This is due to the short-term structure of the subject. An individual does have the option of taking a certification exam for the particular applications subject. The passing grades for these certifications are determined by the testing entity.
ADMISSIONS REQUIREMENTS
Minimum age requirement to attend any seminar at New Horizons Consumer Learning Centers of Austin LLC is 18 years of age.
Entrance examinations are not required to enter a seminar. New Horizons Consumer Learning Centers of Austin LLC strongly suggests the student complete a self-assessment test.
Specific seminars may also require prerequisite seminars or equivalent computer knowledge. For more information on prerequisites refer to the New Horizons Computer Learning Center schedule. Seminar outlines can be viewed and printed from the New Horizons web site at www.newhorizons.com. Individual copies can be made upon request to the front desk staff.
Note:
If you have no experience with computers, request information on the “Computers Made Easy” seminar from your Representative (Account Executive).
MAKE-UP WORK
No more than 5% of the total clock hours for a course may be made up. The student must show good cause for needing to make up the work missed. The school fully understands that circumstances arise that may cause the student to fail to complete an assignment (i.e. illness, death in family, family crisis). Determination will be made on a case by case basis.
The following is taken from Texas Administrative Code Title 40 Part 20 Chapter 807 §807.174
Make-up work shall:
(1) be supervised by an instructor approved for the subject being made up;
(2) require the student to demonstrate substantially the same level of knowledge or competence expected of a student who attended the scheduled class session;
(3) be completed within two weeks of the end of the grading period during which the absence occurred;
(4) be documented by the school as being completed, recording the date, time, duration of the
make-up session, and the name of the supervising instructor; and
(5) be signed and dated by the student to acknowledge the make-up session.
LEAVE OF ABSENCE
The School Director may grant a leave of absence if the student can show good cause (see make up). No more than 2 leave of absences will be granted within a 12 month period. Seminars of 40 hours or less will not be granted a leave of absence.
A seminar of 200 clock hours or less, a student may be on leave of absence for a total of 30 calendar days. For seminars of more than 200 clock hours, a student may be on leave of absence for a total of 60 calendar days.
School attendance records shall clearly define the dates of the leave of absence. A written statement as to why the leave of absence was granted, signed by the student and the school director indicating approval, shall be placed in the student's permanent file.
TARDIES
Students that are more than 15 minutes late are marked tardy. If the student is 30 minutes or more late, they are not admitted to class if they are taking a seminar that is 7 clock hours in length. The student will be required to reschedule said seminar. A student that is tardy 4 times will be marked as absent on the 4th tardy for all other classes that are greater than 7 clock hours in length.
INCOMPLETES/WITHDRAWALS
There may be times when a student finds themselves in a situation that forces them to withdraw from a class. New Horizons Consumer Learning Center of San Antonio, LLC has a 6 month retake policy for classes. This allows the student the opportunity to retake a class that they were forced to withdraw from or to reinforce the skills that were previously learned. These classes will be on a space available basis. Students that were issued a refund will not be allowed to repeat any classes that were not previously paid for.
Students with incompletes will also be afforded the opportunity to retake the class they failed to complete. When readmitted the student will have to wait until the next course cycle. The 6 month retake policy is still in effect.
CANCELLATION POLICY
New Horizons Consumer Learning Center of Austin, LLC will follow the guidelines for attendance as set forth in the Texas Administrative Code Title 40 Part 20 Chapter 807 Subchapters 807.171 and 807.173-

REFUND POLICY
1. Refund computations will be based on the period of enrollment computed on basis of course time (clock hours).
2. The effective date of termination for refund purposes will be the earliest of the following:
(a) The last day of attendance; or
(b) The date of receipt of written notice from the student.
3. If tuition and fees are collected in advance of entrance, and the student does not enter school, not more than $100 shall be retained by the school.
4. If the student fails to enter the seminar, withdraws, or is discontinued at any time before completion of the seminar, the student will be refunded the pro rata portion of tuition, fees, and other charges that the number of class hours remaining in the seminar after the effective date of termination bears to the total number of class hours in the seminar.
5. A full refund of all tuition and fees is due in each of the following cases:
(a) an enrollee is not accepted by the school;
(b) if the seminar of instruction is discontinued by the school and thus prevents the student from completing the seminar; or
(c) if the student's enrollment was procured as a result of any misrepresentation in advertising, promotional materials of the school, or misrepresentations by the owner or representatives of the school.
REFUND POLICY (VA)
1. It is understood and agreed that the following refund policy will be applied to veterans and other eligible persons.
2. In the event the veteran or other eligible person fails to enter the course, or withdraws, or is discontinued there from at any time prior to completion
of the approved course length for VA students, the amount charged to the student for tuition, fees, and other charges for the completed portion
of the course shall not exceed $10.00(only if a registration fee is charged) plus the approximate pro rata portion of the total charges for tuition, fees,
and other charges that the length of the completed portion of the course bears to its total length. The competed portion is the total number of days the student was scheduled to attend (from first to last day of attendance) multiplied by the scheduled hours of attendance per day.
3. New Horizons Consumer Learning Center of San Antonio, LLC will follow the VA Worksheet (Ref. 38, CFR 21.4254, 21.4255) attached for all refunds
as required by the Texas Veterans Commission.
REFUND POLICY (FOR STUDENTS CALLED TO ACTIVE MILITARY SERVICE)
A student of the school or college who withdraws from the school or college as a result of the student being called to active duty in a military service of the United States or the Texas National Guard may elect one of the following options for each course in which the student is enrolled:
1. if tuition and fees are collected in advance of the withdrawal, a pro rata refund of any tuition, fees, or other charges paid by the student for the course and a cancellation of any unpaid tuition, fees, or other charges owed by the student for the portion of the course the student does not complete following withdrawal;
2. a grade of incomplete with the designation "withdrawn-military" for the courses in the course, other than courses for which the student has previously received a grade on the student's transcript, and the right to re-enroll in the course, or a substantially equivalent course if that course is no longer available, not later than the first anniversary of the date the student is discharged from active military duty without payment of additional tuition, fees, or other charges for the course other than any previously unpaid balance of the original tuition, fees, and charges for books for the course; or
3. the assignment of an appropriate final grade or credit for the courses in the course, but only if the instructor or instructors of the course determine that the student has:
(A) satisfactorily completed at least 90 percent of the required coursework for the course; and
(B) demonstrated sufficient mastery of the course material to receive credit for completing the course.
GRIEVANCES
If a student has issues that he/she feels needs to be addressed, the following guidelines need to be adhered to:
The student needs to submit in a timely manner, all relevant information concerning said issues. This information needs to be specific and honest.
If the issues are with the instructor/representative the student will be referred to the next person in the chain of hierarchy.
If the complaint is with upper management, i.e. School Director and the General Manager will be notified. If none of the preceding applies the following guidelines will be followed:
The student should contact his/her instructor or representative to set up a meeting to discuss the issues at hand. After speaking with the instructor/representative if the student’s issues are not resolved, the student may request a meeting with the instructor’s/representative’s immediate supervisor to try and resolve the issue/dispute.
If the meeting with the supervisor does not come to an agreement, the student has the right to speak with the School Director in order to resolve the issues at hand. If the student’s concerns are not met, the student will be referred to the General Manager.
If after meeting with the General Manager, the student is still not satisfied with the outcome of all aforementioned channels, he/she will be given TWC form PS-041A. This is the Texas Workforce Commission’s Student Complaint Form.
