austin terms and conditionsATTENDANCE POLICYStudents need to attend each class day to receive the recommended and optimal instruction. Application seminars (i.e., Excel, Word, etc) are one day in length with the exception of beginning database and desktop publishing seminars, which are two days in length. Technical (i.e., Novell, Microsoft) are from one to five days in length. Students are strongly recommended to attend all seminar days to enable the student to satisfy the vendor’s requirements for certification. Students who do not atend the required number of seminars days cannot be issued a certificate of completion. New Horizons Consumer Learning Centers of Austin, LLC will terminate the enrollment of students who are absent more than 25% of the total clock hours for any seminar. Re-admission to seminars will be arranged after consultation with a New Horizons Learning Centers of Austin, LLC representative. Admission to seminars will not be allowed 20 minutes after the start of class. TERMINATION POLICYNew Horizons Consumer Learning Centers of Austin, LLC will follow the guidelines for attendance as set forth in the Texas Administrative Code Title 40 Part 20 Chapter 807 Subchapters 807.171 and 807.173- (a) A school shall terminate the enrollment of a student who accumulates the lesser of the following amounts of absences
(b) Students whose enrollments are terminated for violation of the attendance policy may not reenroll before the start of the next progress evaluation period. This provision does not circumvent the approved refund policy. A school shall charge for a full day of absence when the student fails to attend all of the scheduled classes on that day. The school shall charge for a partial day of absence for any period of absence during the day. CONDUCT POLICYAll students attending New Horizons Consumer Learning Centers of Austin, LLC will be expected to act in a responsible and professional manner. Instructors will keep control of the seminar, if a student becomes unruly due to excessive negative comments, loud and obnoxious behavior or language, profanity or comments of a sexual or derogatory nature he/she will be escorted from seminar. Surfing pornographic or illegal downloading websites is against New Horizons Consumer Learning Centers of Austin, LLC computer usage policy and the student will be immediately removed from the seminar. Students attend New Horizons Consumer Learning Centers of Austin, LLC to advance his/her computer knowledge and skills, non participation will not be dealt with by the instructor or staff. New Horizons Learning Centers of Austin, LLC will make every effort to assist a student who has difficulty or a concern, but any behavior that is detrimental to the class will not be tolerated. A student will be re-admitted to class only after an interview with New Horizons Consumer Learning Centers of Austin, LLC management team member has determined that the student will not continue the actions for which he/she was dismissed. EXAM PASSAGE RATESStudents in certificate courses will receive an exam rate of “satisfactory” or “unsatisfactory”. The determination of this exam rate is based on the student’s class attendance and the completion of laboratory assignments. Laboratory assignments are used to demonstrate knowledge. Satisfactory is defined as 70% completion of laboratory assignments and demonstration of proficiency in a subject matter. Each class in the certification is rated individually and a student is required to obtain a “satisfactory” before being allowed to continue to the next class in a certification, if pre-requisite is required. Students who receive an “unsatisfactory”, they will be counseled in problem areas and allowed to re-take the laboratory assignment. If the student receives a rate of “satisfactory” on the re-take, he/she will be allowed to continue with the course. If the student receives a rate of “unsatisfactory” on the re-take they will be terminated from the course. If they are VA or TWC-WIA students, they will be reported on the unsatisfactory progress. Students will be given certifications upon completion. ENROLLMENT POLICYMinimum age requirement to attend any seminar at New Horizons Consumer Learning Centers of Austin, LLC is 18 years of age. Entrance examinations are not required to enter a seminar. New Horizons Consumer Learning Centers of Austin, LLC strongly suggests the student complete a self-assessment test. Specific seminar may also require prerequisite seminars or equivalent computer knowledge. For more information on prerequisites refer to the New Horizons Consumer Learning Centers of Austin, LLC schedule. Seminar outlines can be viewed and printed from the New Horizons Consumer Learning Centers of Austin, LLC web site at www.newhorizons.com. Individual copies can be made upon request to the front desk staff. Note: If you have no experience with computers, request information on the “Computers Made Easy” seminar from your Representative (Account Executive). MAKE-UP WORKNo more than 5% of the total clock hours for a program may be made up. The student must show good cause for needing to make up the work missed. The school fully understands that circumstances arise that may cause the student to fail to complete an assignment (i.e. illness, death in family, family crisis). Determination will be made on a case by case basis. The following is taken from Texas Administrative Code Title 40 Part 20 Chapter 807 §807.174 Make-up work shall: (1) be supervised by an instructor approved for the subject being made up; (2) require the student to demonstrate substantially the same level of knowledge or competence expected of a student who attended the scheduled class session; (3) be completed within two weeks of the end of the grading period during which the absence occurred; (4) be documented by the school as being completed, recording the date, time, duration of the make-up session, and the name of the supervising instructor; and (5) be signed and dated by the student to acknowledge the make-up session. LEAVE OF ABSENCEThe School Director may grant a leave of absence if the student can show good cause (see Make-Up Work). No more than 2 leave of absences will be granted within a 12 month period. Seminars of 40 hours or less will not be granted a leave of absence. A seminar of 200 clock hours or less, a student may be on leave of absence for a total of 30 calendar days. For seminars of more than 200 clock hours, a student may be on leave of absence for a total of 60 calendar days. School attendance records shall clearly define the dates of the leave of absence. A written statement as to why the leave of absence was granted, signed by the student and the school director indicating approval, shall be placed in the student's permanent file. CANCELLATION AND REFUND POLICY1. Refund computations will be based on the period of enrollment computed on basis of course time (clock hours). 2. The effective date of termination for refund purposes will be the earliest of the following:
3. If tuition and fees are collected in advance of entrance, and the student does not enter school, not more than $100 shall be retained by the school. 4. If the student fails to enter the seminar, withdraws, or is discontinued at any time before completion of the seminar, the student will be refunded the pro rata portion of tuition, fees, and other charges that the number of class hours remaining in the seminar after the effective date of termination bears to the total number of class hours in the seminar. 5. A full refund of all tuition and fees is due in each of the following cases:
REFUND POLICY (VA)1. It is understood and agreed that the following refund policy will be applied to veterans and other eligible persons. 2. In the event the veteran or other eligible person fails to enter the course, or withdraws, or is discontinued there from at any time prior to completion of the approved program length for VA students, the amount charged to the student for tuition, fees, and other charges for the completed portion of the course shall not exceed $10.00(only if a registration fee is charged) plus the approximate pro rata portion of the total charges for tuition, fees, and other charges that the length of the completed portion of the course bears to its total length. The competed portion is the total number of days the student was scheduled to attend (from first to last day of attendance) multiplied by the scheduled hours of attendance per day. 3. New Horizons Consumer Learning Centers of Austin, LLC will follow the VA Worksheet (Ref. 38, CFR 21.4254, 21.4255) attached for all refunds as required by the Texas Veterans Commission. REFUND POLICY (FOR STUDENTS CALLED TO ACTIVE MILITARY SERVICE)A student of the school or college who withdraws from the school or college as a result of the student being called to active duty in a military service of the United States or the Texas National Guard may elect one of the following options for each program in which the student is enrolled: 1. If tuition and fees are collected in advance of the withdrawal, a pro rata refund of any tuition, fees, or other charges paid by the student for the program and a cancellation of any unpaid tuition, fees, or other charges owed by the student for the portion of the program the student does not complete following withdrawal; 2. A grade of incomplete with the designation "withdrawn-military" for the courses in the program, other than courses for which the student has previously received a grade on the student's transcript, and the right to re-enroll in the program, or a substantially equivalent program if that program is no longer available, not later than the first anniversary of the date the student is discharged from active military duty without payment of additional tuition, fees, or other charges for the program other than any previously unpaid balance of the original tuition, fees, and charges for books for the program; or 3. The assignment of an appropriate final grade or credit for the courses in the program, but only if the instructor or instructors of the program determine that the student has:
GRIEVANCESIf a student has issues that he/she feels needs to be addressed, the following guidelines need to be adhered to: The student needs to submit in a timely manner, all relevant information concerning said issues. This information needs to be specific and honest. If the issues are with the instructor/representative the student will be referred to the next person in the chain of hierarchy.If the complaint is with upper management, i.e. School Director and the General Manager will be notified. If none of the preceding applies the following guidelines will be followed: The student should contact his/her instructor or representative to set up a meeting to discuss the issues at hand. After speaking with the instructor/representative if the student’s issues are not resolved, the student may request a meeting with the instructor’s/representative’s immediate supervisor to try and resolve the issue/dispute. If the meeting with the supervisor does not come to an agreement, the student has the right to speak with the School Director in order to resolve the issues at hand. If the student’s concerns are not met, the student will be referred to the General Manager. If after meeting with the General Manager, the student is still not satisfied with the outcome of all aforementioned channels, he/she will be given TWC form PS-041A.
